A bodyguard employed through a government protection program to protect the head of the human rights or-ganization Reiniciar has been shot and killed, and other staff of the organisation are believed to be in danger. The man killed was the son of an activist for a left-wing political party, and its members may also be targets. The gunmen are thought to be members of a paramilitary organization. Bodyguard Higinio Baquero Mahecha had been assigned to Reiniciar executive director Jahel Quiroga Carrillo, as part of the protection measures the government provided to the organisation at the request of the Inter-American Commission on Human Rights (IACHR). On 12 April he apparently left the Reiniciar offices in the capi-tal, Bogotá, and caught a bus to the district of the city where he lived. Two gunmen got on the bus shortly af-terwards, and shot him several times in the head. He was taken to hospital, where he died after six hours of treatment. Reiniciar has campaigned for justice for the families of over 3000 members of the left-wing political party Unión Patriótica (UP), Patriotic Union, who were killed or "disappeared" since the party was formed in 1985, mostly at the hands of the security forces and army-backed paramilitaries. Jahel Quiroga and other members of Reiniciar have been repeatedly threatened possibly by paramilitary organizations, which is what led the IACHR to ask for protection for them. Higinio Baquero’s father was an activist for the UP, which is closely linked to the Partido Comunista Colombiano (PCC), Colombian Communist Party. He was reportedly killed in 2004 in the department of Meta. Because of the killing Higinio Baquero moved to Bogotá with his wife and children.

Background information

UP and PCC members and activists have frequently been labelled guerrilla sympathizers and collaborators by the security forces and their paramilitary allies. Such accusations have frequently been followed by serious hu-man rights violations including extrajudicial executions and "disappearances". Human rights defenders and oth-ers campaigning for justice in cases of human rights violations against PCC and UP activists and many other cases have similarly been the target of serious human rights violations. Guerrilla forces have also been respon-sible for killing and threatening civilians they consider to be collaborating with their enemies.

Recommended Actions

Please send appeals to arrive as quickly as possible, in Spanish or your own language:

• expressing concern that a bodyguard employed to protect Reiniciar executive director Jahel Quiroga Carrillo was shot dead on 12 April
• expressing concern for the safety of Reiniciar members and the family of the bodyguard, Higinio Baquero Mahecha
• urging the authorities to take action to guarantee their safety, and provide them with adequate protection, in accordance with their wishes, so that Reiniciar members may continue their legitimate work in safety
• calling on the authorities to conduct an immediate, impartial and full investigation of the killing, make the results public and bring those responsible to justice
• reminding the authorities that their obligations to human rights defenders are laid out in the UN Declaration on Human Rights Defenders, the Organization of American States Human Rights Defenders in the Americas resolutions and in repeated recommendations made to them by the UN.

Temor por la seguridad de:

Hollman Morris, periodista y director del programa Contravía

Gloria Cuartas, líder política y candidata en las últimas elecciones al Senado

Javier Giraldo Moreno, sacerdote jesuita, conocido defensor de derechos humanos

Me dirijo a Usted en mi calidad de miembro de la Sección Suiza de Amnistía Internacional, una organización mundialmente conocida y reconocida por su compromiso y promoción de de los derechos humanos.

Con todo respeto vuelvo a escribirle para manifestarle mi más profunda preocupación por la seguridad de las personas nombradas en la referencia.

Según las informaciones emitidas por Amnistía Internacional, las que merecen toda mi confianza, me he enterado que ha sido producido un video por un nuevo grupo paramilitar a nivel nacional autodenominado “Frente Social por la Paz”. Este video fue distribuido, aparentemente por miembros de las fuerzas armadas, a principios de marzo de 2006, en la última fase de la campaña electoral para el Senado, especialmente entre los estudiantes de la Universidad Nacional de Colombia en Bogotá. En la mencionada cinta se acusa a Hollman Morris, Gloria Cuartas, Javier Giraldo Moreno y a otros de ser miembros y/o agentes de la guerrilla y se los declara como objetivo militar.

El Sr. Hollman Morris es un conocido periodista y director de un programa de investigación periodística llamado CONTRAVÍA, quien ya ha sido amenazado el año pasado por su programa sobre la masacre en la Comunidad de Paz de San José de Apartadó del 21 de febrero de 2005. A pesar de que los periodistas amenazados en aquel entonces han recibido protección adicional, no se sabe hasta el momento, si las investigaciones por las amenazas han dado algún resultado ni si los responsables materiales e intelectuales de las mismas han debido comparecer ante la justicia. Esta situación de impunidad no hace sino aumentar el riesgo para todos aquellos que denuncian violaciones a los derechos humanos cometidos por miembros de las fuerzas de seguridad o de sus aliados paramilitares.

Tanto la Sra. Gloria Cuartas como el Padre Javier Giraldo Moreno han criticado en repetidas oportunidades las violaciones a los derechos humanos perpetradas por las fuerzas de seguridad y sus aliados paramilitares.

También los grupos guerrilleros han amenazado y asesinado a personas a las que acusan de colaborar con el enemigo y son responsables de un sinnúmero de secuestros y toma de rehenes.

Como es de su conocimiento, los acontecimientos del pasado han demostrado que acusaciones y amenazas por parte de grupos paramilitares de pertenecer y/o apoyar a la guerrilla han sido seguidas de graves violaciones a los derechos humanos, lo que no hace sino aumentar mi preocupación por la seguridad de las personas citadas en la referencia.

Defensores de derechos humanos, periodistas, funcionarios públicos elegidos y candidatos electorales en numerosos casos han sido ellos mismos víctimas de intimidaciones, amenazas y asesinatos cuando han declarado su compromiso por el esclarecimiento de violaciones a los derechos humanos perpetrados por las fuerzas de seguridad y sus aliados paramilitares.

Por todo esto solicito a Usted y a las autoridades colombianas:

• tomar medidas de protección en coordinación con los propios amenazados para garantizar la seguridad de los mismos, de manera que puedan continuar con su legítimo trabajo;
• impartir las órdenes necesarias para iniciar sin dilación investigaciones profundas e independientes sobre las amenazas contra Hollman Morris, Javier Giraldo Moreno y Gloria Cuartas contenidas en el video del grupo paramilitar “Frente Social por la Paz” e investigaciones de igual carácter sobre la presunta participación en la distribución del video por miembros de las fuerzas armadas, que los resultados de las mismas se hagan públicos y que los responsables deban comparecer ante los estrados judiciales;
• iniciar investigaciones completas e imparciales sobre los vínculos entre las fuerzas de seguridad y los grupos paramilitares, que los resultados se hagan públicos y que los responsables de pertenecer y/o apoyar a dichos grupos comparezcan ante la justicia, tal como lo estipulan las recomendaciones hechas por las Naciones Unidas en este sentido.
